PRACTICAL RESEARCH GUIDE
Building a source-based leave and working-hours policy
Identify the establishment and worker group
Choose the state and the legislation governing the establishment before selecting an entitlement. Shops, factories, mines and other activities can fall under different provisions. Check exemptions and sector notifications, including conditions attached to extended opening hours or night work. Permission for an establishment to remain open does not automatically remove employee rest, overtime or safety requirements.
Separate each leave balance
Earned or privilege leave, sick leave, casual leave, maternity benefits, weekly rest and festival holidays are distinct concepts. Record qualifying service, accrual, carry-forward, lapse, encashment and evidence requirements for each applicable category. A total labelled leave in an attendance spreadsheet does not show which legal entitlement was used. Read the available Delhi, Telangana, Maharashtra, Tamil Nadu and Kerala references separately; one state’s totals must not be applied to another.
Distinguish work, rest and overtime
A daily work limit, weekly work limit, rest interval and spread-over measure different things. A long span between entry and exit is not necessarily identical to hours actually worked, but breaks must meet the governing requirements. Reconcile the roster, attendance, leave and overtime calculation. Check the worker category and any permissible exception before approving a schedule.
Check benefit-specific developments
Maternity research needs the Code, applicable coverage, final Rules and relevant judicial developments. The connected maternity reference records the Supreme Court decision of 17 March 2026 removing the adopted-child age restriction in section 60(4). Older summaries that retain that restriction should not be used to refuse a claim. Keep the current source chain and supporting benefit records together.
Common questions
Can we use one leave policy for every state?
A company can organise a common policy, but it must preserve the applicable statutory entitlements and any more favourable protected terms for each covered group.
Are government holidays automatically compulsory private-sector holidays?
No. Check the notification’s scope and the applicable employment or national and festival holiday provisions.
Why are some state references missing?
Entitlement tables are published only after source review. Missing content is a research gap, not a statement that no entitlement exists.
