It Dated July 4, 2025, lays down specific conditions for employing women during night shifts (08:00 PM to 06:00 AM) in certain establishments in Haryana.

Key Points of the Notification:

  1. Applicability: It applies to IT, ITeS, Banking, three-star and above hotels, 100% Export Oriented Units, and Logistics and Warehousing establishments registered under the Punjab Shops and Commercial Establishment Act, 1958, in Haryana. These sectors were already permitted to employ women in night shifts, and this notification supersedes previous ones to outline detailed safeguards.
  2. Exemption Process: Employers must apply for exemption online within two weeks prior to the commencement of the night shift period. The exemption will be granted in auto mode based on self-certification and is valid for one year. Any changes in security, transportation, or details of occupier/director/manager must be intimated online.
  3. Mandatory Safeguards for Women Employees:
    • Sexual Harassment (POSH Act) Compliance: Employers must ensure full compliance with the POSH Act, 2013, including prevention of sexual harassment, providing resolution procedures, and submitting the annual return to the District Authority and Labour Commissioner, Haryana.
    • Consent: Obtain written consent from each woman employee willing to work during night shifts.
    • Lighting: Provide proper lighting inside the establishment and in surrounding areas where female employees may move.
    • Security Guards: Ensure sufficient security guards are present during night shifts.
    • Transportation: Mandatory transportation facility from residence and back, equipped with security guards (including female guards), well-trained drivers, proper communication channels, CCTV, and GPS. (Women can opt-out with written consent; employers can pool transport with external providers).
    • Batch Employment: Workers must be employed in batches of not less than four. However, in IT/ITeS, this can be relaxed for senior women (earning over Rs. 1 lakh/month) if they provide consent.
    • Medical Facility: Appropriate medical facilities (doctor/female nurse) must be available during night shifts. Employers can also tie-up with nearby hospitals for ambulance and medical services. Emergency contact numbers must be displayed.
    • Boarding/Lodging: If provided, facilities for women employees must be exclusively for them and under the control of women wardens/supervisors.
  4. General Compliance: All other provisions of the Punjab Shops and Commercial Establishments Act, 1958, Equal Remuneration Act, ESI, Haryana Labour Welfare Fund, and other applicable labour legislations must be followed.

The notification grants employers the liberty to employ women employees in night shifts, either wholly or partially, provided all the stipulated conditions are strictly complied with.
